Welcome to Nailoscope (“Nailoscope,” “the nail spa,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Nailoscope website (demo.nailoscope.com and any successor domain, the “Site”), as well as the booking, purchase, and receipt of services and products at our nail spa located at 4592 Clairemont Dr #110, San Diego, CA 92117.
By accessing the Site, booking an appointment, or purchasing a service, product, or gift card from Nailoscope, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
1. Acceptance of Terms
By using the Site or engaging Nailoscope’s services, you confirm that you are at least 18 years of age, or that you are accessing the Site under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
2. Services
Nailoscope provides luxury nail care and related spa services, including but not limited to manicures, pedicures, nail enhancements, nail art, and add-on treatments, as further described on the Site. Service availability, pricing, and offerings are subject to change without notice.
3. Appointments, Bookings, and Cancellations
3.1 Booking
Appointments may be scheduled through the Site, by phone, or in person, subject to availability.
3.2 Cancellation and Rescheduling
We ask that you provide at least [24/48] hours’ notice to cancel or reschedule an appointment. Late cancellations or no-shows may be subject to a fee, at Nailoscope’s discretion, which will be disclosed at the time of booking.
3.3 Late Arrivals
Arriving late to an appointment may result in a shortened service to accommodate other scheduled guests, at full price, or the need to reschedule.
3.4 Deposits
Certain services, group bookings, or private events may require a deposit at the time of booking. Deposit terms will be communicated at booking and are non-refundable except where required by law.
4. The Nailoscope Way™ — Service Satisfaction Policy
Nailoscope is committed to delivering an exceptional guest experience. If you are not fully satisfied with your service, please notify us within 7 days of your appointment. In accordance with The Nailoscope Way™, we will provide a complimentary redo of the affected service within 7 days of the original appointment date. This is our standard resolution for service quality concerns, and no additional compensation, discount, or refund will be issued beyond the complimentary redo.
5. Payment and Pricing
5.1 All prices listed on the Site or in the nail spa are subject to change without prior notice.
5.2 Payment is due in full at the time services are rendered, unless otherwise agreed in writing (e.g., for group packages or private events).
5.3 Nailoscope accepts the payment methods indicated at the point of sale. Gratuities are not included in listed service prices unless otherwise stated.
6. Gift Cards and Packages
6.1 Gift cards and prepaid packages sold by Nailoscope are non-refundable and non-transferable for cash value, except as required by applicable law.
6.2 Gift cards and packages are valid for the period stated at the time of purchase and may be subject to expiration in accordance with California law.
6.3 Lost or stolen gift cards will not be replaced unless proof of purchase is provided.
7. Group Packages and Private Events
Group bookings, private events, and external events booked through Nailoscope are subject to separate event terms, which may include minimum spend requirements, deposits, cancellation windows, and guest count confirmations. These terms will be provided at the time of booking and, where they conflict with these general Terms, the event-specific terms will govern.
8. Health, Safety, and Client Responsibilities
8.1 Please inform our staff of any allergies, sensitivities, skin conditions, infections, injuries, or medical conditions prior to your service so that we may take appropriate precautions.
8.2 Nailoscope reserves the right to decline or modify service if a health or safety concern is identified (e.g., signs of infection, open wounds, or communicable conditions).
8.3 Clients participate in services at their own risk. Nailoscope is not liable for allergic reactions, adverse skin reactions, or complications arising from undisclosed medical conditions, medications, or product sensitivities.
8.4 Nailoscope maintains sanitation and hygiene practices in accordance with California State Board requirements. Any concerns regarding hygiene or sanitation should be raised with staff or management immediately.
9. Children and Minors
Minors receiving services must be accompanied by a parent or legal guardian. Certain services may have age restrictions; please inquire prior to booking.
10. Limitation of Liability
To the fullest extent permitted by law, Nailoscope, its owner, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or receipt of services. Nailoscope’s total liability for any claim arising from a service shall not exceed the amount paid for that service.
11. Personal Belongings
Nailoscope is not responsible for lost, stolen, or damaged personal belongings brought into the nail spa.
12. Intellectual Property
All content on the Site, including logos, text, graphics, images, and design elements, is the property of Nailoscope and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without prior written permission.
13. User Conduct
You agree not to use the Site to: (a) violate any applicable law; (b) transmit harmful or malicious code; (c) attempt to gain unauthorized access to Site systems; or (d) submit false, misleading, or fraudulent booking information.
14. Third-Party Links
The Site may contain links to third-party websites (e.g., booking platforms, social media, or partner brands). Nailoscope is not responsible for the content, policies, or practices of any third-party site.
15. Reviews and Feedback
Any reviews, testimonials, or feedback submitted to Nailoscope or third-party platforms may be used by Nailoscope for promotional purposes unless you request otherwise in writing.
16. Employment and Vendor Inquiries
Career, staffing, and vendor inquiries submitted through the Site are subject to Nailoscope’s separate hiring and vendor policies and do not constitute an offer of employment or contract.
17. Modifications to Terms
Nailoscope reserves the right to update or modify these Terms at any time. Continued use of the Site or our services following any changes constitutes acceptance of the updated Terms.
18. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Diego County, California.
19. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
